Under the Higher Education Act, institutions of higher education are prohibited from misrepresenting the nature of their educational programs, financial charges, or the employability of their graduates. Accordingly, Northland Community & Technical College, including its employees, representatives, or contractors, must not make any false, erroneous, or misleading statements, either directly or indirectly, to students, prospective students, the public, accrediting bodies, state agencies, or the U.S. Department of Education.
A misleading statement is any communication (written, oral, visual, or otherwise) that has the potential to deceive, confuse, or mislead. This includes endorsements or testimonials provided by students under pressure or as a requirement for program participation.
According to federal regulations, substantial misrepresentation occurs when a person could reasonably rely on inaccurate information to their detriment.
Areas subject to misrepresentation regulations include:
- Nature of the educational program (e.g., programs of study, course content, transferability of credits)
- Nature of financial charges (e.g., tuition, fees, payment policies)
- Employability of graduates (e.g., job placement rates, licensing requirements)
- Relationship with the U.S. Department of Education (A Title IV eligible institution must not imply that participation constitutes endorsement or approval of the institution’s programs by the Department)
Oversight and Responsibilities
- The Marketing Department retains all promotional and marketing materials for the College.
- The Director of Admissions, Engagement & Retention oversees training to ensure accurate representation of admissions requirements and related information.
- The Academic Deans are responsible for training staff on accurate communication regarding academic programs, student outcomes, and related content.
- The Business Manager provides training to prevent misrepresentation related to tuition, fees, refund policies, and other financial matters.
- The Director of Financial Aid is responsible for training on the proper representation of financial aid options and policies.
